Terms and Conditions

This page is maintained by The Eyekon Group Limited to explain the terms that apply when you use our services.

By using the services of The Eyekon Group Limited, requesting a vehicle, authorising a bid, making a payment or purchasing a vehicle, you agree to the following terms.

1. Scope of Service

The Eyekon Group Limited provides vehicle sourcing, auction bidding assistance, dealership and private-seller purchases, vehicle sales, inland transportation, international shipping and delivery support.

2. Prices and Estimates

Vehicle prices, auction fees, shipping charges, customs duties, port charges, taxes and repair estimates may change. Any customs, clearance or repair figures provided are estimates only. Final charges are determined by the relevant authorities or service providers.

3. Deposits and Payments

A deposit may be required to reserve a vehicle, begin sourcing or authorise bidding. Unless otherwise confirmed in writing, deposits are non-refundable once administrative, sourcing, bidding or procurement work has started.

Vehicles will only be released, transferred or delivered after full payment has been received and cleared.

4. Vehicle Condition

Vehicles are generally sold on an “as-is” basis unless a written warranty is provided. Customers are encouraged to arrange an independent inspection before purchase.

The Company will provide available information about mileage, condition, title status and visible damage, but hidden or future defects may not always be identified before purchase.

5. Auction and Availability

Submitting a bidding request does not guarantee that a vehicle will be won. Auction prices may rise above the customer’s budget, and vehicles may be sold, withdrawn or become unavailable without notice.

6. Shipping and Customs

Shipping and delivery dates are estimates only. Delays may result from weather, port congestion, customs procedures, inspections, shipping schedules or other circumstances outside the Company’s control.

Customers are responsible for final customs duties, port fees, clearance charges and other government costs.

7. Border and Container Inspections

Customs or port authorities may randomly inspect vehicles or containers. Any resulting inspection, storage, scanning, shifting, destuffing or handling charges are payable by the affected customer.

Where several customers share one container, inspection-related charges may be divided proportionately.

8. Customer Responsibilities

Customers must provide accurate information, review vehicle details, confirm their budget, pay invoices on time, supply required documents and meet customs or clearance requirements.

Additional costs caused by delayed payment, missing documents or late vehicle collection will be the customer’s responsibility.

9. Limitation of Liability

To the extent permitted by law, The Eyekon Group Limited will not be responsible for indirect or consequential losses caused by shipping delays, customs holds, storage fees, government inspections, towing costs, loss of income, third-party failures or mechanical problems discovered after delivery.

10. Website Information

Vehicle availability, prices, exchange rates, shipping costs and customs estimates shown on the website may change. Website information is not a final invoice or binding quotation unless confirmed in writing by the Company.

11. Governing Law

These Terms and Conditions are governed by the laws of Canada and the province in which The Eyekon Group Limited is incorporated.

12. Changes to Terms

The Company may update these Terms to reflect legal, regulatory or operational changes. The latest version will be published on the official website.
