Terms and Conditions of Business
Welcome to The Eyekon Group LTD. These Terms and Conditions govern the sale of vehicles, vehicle sourcing services, and the use of our official website. By engaging our services or purchasing a vehicle from us, you agree to be bound by the terms outlined below.
1. Corporate Identity & Scope of Service
- 1.1.Incorporated Entity: All business transactions, sales contracts, and vehicle sourcing agreements are strictly between the client and the corporate entity, The Eyekon Group LTD.
- 1.2.Service Description: The Eyekon Group LTD. facilitates the sourcing, marketing, dealership inventory sales, and commercial delivery of pre-owned and imported motor vehicles.
2. Pricing Transparency & Financial Estimates
We are committed to 100% pricing transparency. However, due to the nature of vehicle sourcing and international port logistics, buyers must acknowledge the following cost structures:
- 2.1.Base Purchase Price: This is the fixed corporate cost agreed upon for the vehicle itself, excluding external government fees, provincial taxes, or port duties.
- 2.2.Port Duties & Customs Fees: For imported vehicles, any figures provided by the corporation regarding customs duties, port clearance, or government taxes are estimates only. Final assessments are determined solely by customs authorities at the port of entry, and the buyer is responsible for the actual final amount required for clearance.
- 2.3.Vehicle Conditioning & Repairs: Unless explicitly sold with a written corporate warranty, vehicles are sold on an “as-is” basis with full disclosure. Any estimated repair, mechanical servicing, or cosmetic touch-up costs provided by us are guidelines to assist client budgeting. Actual repair costs incurred after delivery are the sole responsibility of the buyer.
3. Deposits, Payments, and Corporate Taxation
- 3.1.Hold Deposits: A corporate deposit may be required to reserve a vehicle or initiate a sourcing request. Unless stated otherwise in writing by the company, deposits are non-refundable as they cover immediate administrative and procurement costs.
- 3.2.Corporate Taxation (GST/HST): All sales and services are subject to applicable federal and provincial taxes (GST/HST), which will be clearly itemized on your official invoice issued by The Eyekon Group LTD.
- 3.3.Final Payment: Corporate ownership transfer and vehicle delivery will only take place once full, verified payment has been received and cleared by our financial institution into the corporate bank account.
4. Vehicle Inspection and Acceptance
- 4.1.Independent Inspection: We highly encourage all buyers to thoroughly inspect vehicles or arrange a third-party mechanical inspection prior to finalizing the purchase.
- 4.2.Final Acceptance: Once a vehicle is accepted and driven off our lot or cleared from the port by the buyer, the sale is considered final. The Eyekon Group LTD. is not liable for mechanical failures or cosmetic defects discovered after delivery.
5. Random Border Inspections and Examination Fees
- 5.1.Government Inspections: The Canada Border Services Agency (CBSA) or relevant port authorities reserve the right to randomly select shipping containers for physical inspection, X-ray scanning, or intensive examinations.
- 5.2.Transfer of Fees: In the event that a container carrying your vehicle is selected for a random government inspection, all resulting costs — including but not limited to port storage fees, container shifting, destuffing, examination warehouse charges, and customs delays — are outside the control of The Eyekon Group LTD.
- 5.3.Pro-Rata Allocation: If a container holds multiple vehicles belonging to different clients, these inspection-related charges will be divided and allocated on a pro-rata (proportionate) basis among all customers who have vehicles inside that specific container.
- 5.4.Obligation to Pay: The customer is strictly obligated to pay their share of the inspection fees in full.
- 5.5.Forfeiture and Risk of Loss: Failure or refusal to clear these government-mandated fees within the timeline specified by the port authority will result in the port holding or seizing the cargo. If a customer refuses to pay their allocated share of the inspection costs, they risk total forfeiture and loss of the vehicle, and The Eyekon Group LTD. shall bear no financial liability or obligation to refund any prior payments, deposits, or purchase amounts.
6. Corporate Limitation of Liability
The Eyekon Group LTD., its directors, officers, employees, and agents shall not be held liable for any indirect, incidental, or consequential damages (including but not limited to loss of income, towing fees, or alternative transportation costs) arising from vehicle delays at the port, customs holds, or mechanical issues developed post-sale.
7. Governing Law
These Terms and Conditions are governed by and construed in accordance with the corporate laws of Canada and the province of incorporation. Any legal disputes arising from these terms shall be resolved within the appropriate provincial court jurisdiction.
8. Changes to Terms
The Eyekon Group LTD. reserves the right to modify these Terms and Conditions at any time to reflect regulatory changes or updates to our operational processes. Updated terms will be posted on our official website.
